ES&S ExpressVote XL Settlement

Citizens for Better Elections has settled its lawsuit over the Pennsylvania certification of the ES&S ExpressVote XL voting machine, which is used for in-person voting in Philadelphia, Northampton, and Cumberland counties.

As the litigation was pending, ES&S released updated software to address some of the machine’s many flaws. The settlement requires the counties to use this software and to implement additional security procedures required by the Secretary’s re-examination, in time for the 2024 election.

The settlement also provides unprecedented public access to reports about the real-world performance and malfunctions of voting systems in all Pennsylvania counties and guarantees robust public access to future voting system examinations.
